A landlord who wants to raise rent by more than the annual guideline (2.1% in 2026) must apply to the LTB with an L5 application. These appear on building pages here as AGI orders.
What qualifies
Only three things: eligible capital expenditures (major structural work — not ordinary maintenance), an extraordinary increase in municipal taxes, or new security services. Capital-work AGIs are capped at 3% per year above the guideline, spread over up to three years.
What tenants can do
You are entitled to see the landlord's evidence, challenge whether the work was necessary or already covered by reserve funds, and argue that inadequate maintenance should reduce or dismiss the increase. Tenant associations that organize before the hearing routinely reduce AGIs; the order, once issued, states exactly what percentage applies and when.
